“Airport” means Chhatrapati Shivaji International Airport, Mumbai. “Booking Process” means action steps by the guest for undertaking the Service booking through online reservation system or through an offline mode as may be acceptable to Aviaxpert. “CSIA” means Chhatrapati Shivaji International Airport, Mumbai.
“Guest(s)” means the person(s) to whom the Service is being rendered / intended to be rendered by Aviaxpert under its brand name ‘Airport Kruz’.
“Guest Service Executive” or “GSE” means an executive, designated by Aviaxpert to provide Service to the Guest(s) at CSIA, Airport.
“Aviaxpert” means Aviaxpert Pvt. Ltd. which is providing PRM Services at CSIA, Airport under its brand name ‘Airport Kruz’.
“No Show” means the failure by the Guest to reach the meeting point and identify himself/herself to GSE as per the meeting time communicated in the Service confirmation by Aviaxpert.
“Online Reservation Engine” means online facility provided by Aviaxpert on Website and is available to Guest(s) for undertaking booking/cancellation of Services subject to the applicable terms and conditions as provided on the Website or as may be agreed by Aviaxpert separately in writing.
“PRM Services” or “Service(s)” means paid wheel chair services provided by Aviaxpert at the Airport and as detailed in Clause 2 below and as may be amended from time to time by Aviaxpert and made available on the Website.
“Website” means www.airportkruz.com.
“Service Add-on” means any service that is offered by Aviaxpert for booking post the selection of base service by the Guest(s).
The scope of Services includes various services and packages broadly defined under following categories:
2.1 Departure Services: Assistance to Guests departing on International or Domestic flight from CSIA.
2.2 Arrival Services: Assistance to Guests arriving on International or Domestic flight at CSIA.
2.3 Transit Services: Assistance to Guests transiting through CSIA.

3.1 Guest(s) must complete the Booking Process on the Website in advance for availing Services and confirmation of Services pursuant to all online and offline request by Guest(s), Aviaxpert shall be subject to availability.
3.2 Guest(s) shall use Online Reservations Engine to make booking for the Services.
3.3 The bookings can be made by the Guest(s) for Service and packages made available online by Aviaxpert from time to time subject to Clause5.7 below.
3.4 Guest(s) are responsible for providing Aviaxpert with correct and legitimate detail(s) about itself during the Booking Process. Aviaxpert at all times shall reserve the right for taking any additional information in relation to Guest(s) during the process of online/offline booking or anytime during the performance of Services or any clarification thereafter.
3.5 Any and/or all request(s) as may be received and acknowledged by Aviaxpert does not guarantee the Service by Aviaxpert and shall be subject to written confirmation by Aviaxpert.
3.6 Aviaxpert reserves the right to accept or decline or cancel Guest(s) request for Service without assigning any reasons.
3.7 During the Booking Process the Guest(s) are requested to take extra care while providing information about themselves, date and time of travel, flight details, pick up location, contact numbers etc. Aviaxpert assumes no responsibility whatsoever on account of any problem that may arise on account of false/ erroneous information provided by Guest(s) to Aviaxpert or any delay or cancellation of flight or for any reason whatsoever including any major event, change in flight schedule, failure of Guest(s) to report at Airport on time. On the happening of any of the events, the Booking shall be cancelled with immediate effect and the Guest(s) shall have to do re-booking to avail the Services.
3.8 Once the Booking Process is completed, Guest can request for cancellation of Services in case of any change in plans and Aviaxpert shall initiate the refund process in line with the Cancellations and Refund Policy provided in Clause 7 below.
3.9 It is hereby clarified that during the process of booking by Online Reservation Engine on Aviaxpert Website, if there is any “transaction fee” which is charged by the bank issuing the credit/debit card, such charges shall be paid by the Guest and Aviaxpert shall have no liability to pay such transaction fee.
4.1 Credit/Debit Card: Payment of online booking is accepted by all major credit/debit card (“Card”). In case the card used to transact online is issued in a country other than India there may be bank charges applicable and Aviaxpert shall not responsible for any charges that may be levied by the Card Issuing Bank. The Card payment is subject to authorization from the bank issuing the Card.
4.2 Net Banking: If the Guest (s) has an account with any of the mentioned banks under the heading net banking on Aviaxpert Website, then Guest (s) can pay for the booking(s) securely through the respective bank's Internet banking option and the amount will be automatically debited from Guest(s) account. Aviaxpert is not liable for any payment authorization, as the payment gateway is responsible only to hand over the information in an encrypted / secure format to the respective bank for authorizing the transaction. Any issue with payment authorization will need to be taken up with Guest(s) respective bank. This facility is valid for all bookings made in Indian Rupees (INR) currency only.

Performance of Services to Guest(s) by Aviaxpert at the Airport shall be subject to following conditions:
5.1 Guest shall identify himself/herself to the GSE or call on the number provided on Service confirmation voucher on arrival at Airport.
5.2 Guest(s) shall be solely responsible for compliance with all governmental regulations upon entry into and exit from Chhatrapati Shivaji International Airport, Mumbai and ensuring that all required documents are in order and also comply with all conditions/requirements stipulated by Government of India and other relevant authorities and agencies in relation to such travel.
5.4 Duration of Service: The performance of Service will commence at the scheduled meeting time or the time of service as per the Service confirmation voucher. However, Aviaxpert at its sole discretion, may permit Guest(s) a window of 15 (Fifteen) minutes from the scheduled meeting time to avail the Service(s).
5.5 In case of any failure of Guest(s) to report on time at the meeting point or the time of service as per the Service confirmation Voucher, she/he shall be deemed as a No Show and the Service will not be assured.
5.6 For each unit of PRM service, Baggage assistance will be provided to Guest(s) for upto one bag of maximum 30 kgs and one handbag which the guest(s) has to keep on his/her lap. In case of more than 2 baggage (handbags and check in baggage both) the guest will have to pay an additional amount of Rs 500 upto 3 more baggage and further Rs. 500/- for another lot of 3 (three) baggage at the time of booking itself. Aviaxpert may accept the additional requirement of porter services on payment of additional charges on the spot, however, the same shall be subject to the availability only.
5.7 Aviaxpert shall at its sole discretion, be entitled to cancel, alter or omit any part of the Service with or without notification to Guest(s) at its sole discretion. In such cases, Aviaxpert’s liability shall be limited to re-performance of the cancelled Service. In cases where Aviaxpert is unable to re-perform the service, partial/full refund may be provided by Aviaxpert to the Guest(s) at its sole discretion.
5.8 Delays and cancellations of Service by Aviaxpert may result from factors beyond its control such as the accidents, governmental restrictions and other events of force majeure, Aviaxpert’s liability shall be limited to re-performance of the cancelled Service.
5.9 Aviaxpert at all times shall reserve the right to withdraw the Service without assigning any reason and without further reference, in case the Guest(s) is / are in breach of any Terms & Conditions of the Service.
5.10 Guest shall not use the Service or its reference for any unlawful or prohibited purposes.
5.11 Aviaxpert at its sole discretion may decline to provide Service in case of any misconduct or any unlawful or prohibited activity by the Guest(s).
5.12 Aviaxpert’s liability, if any, shall in no event exceed the total charges paid by the Guest(s) for the Services. Under no circumstances, Aviaxpert shall be liable for any consequential, exemplary, special, indirect, incidental or punitive damages.
5.13 Guest(s) agrees to indemnify Aviaxpert in respect to all claims, damages, losses, costs, and expenses (including legal expenses) which are awarded against or incurred by Aviaxpert as a direct result of acts or omissions by Guest(s) either during the course of booking and/or using the Service.
5.14 Aviaxpert shall not be liable for the consequences of any delay or for any loss, cost or expense incurred by Guest(s) as a result of the actions of any other party including without limitation the Airline, Customs and Immigration Authorities etc.
5.15 In relation to the Service, Aviaxpert accepts no liability for any items left or disclaimed by the Guest(s) during the Service and after providing the Service.
5.16 By offering Services, Aviaxpert does not accept any liability for damages, losses, or delays that may result on account of improper documents in possession including without limitation of valid ticket, visa, passport or any other requirement in relation to entry, exist, length of stay, special permissions etc. as may be required for traveling through CSIA.
5.17 Once the booking is done and a service voucher is generated, no money shall be refunded if the services are not availed by the Guest(s) for any reason other than reasons mentioned for cancellation at the website.
Aviaxpert will do its utmost to ensure that availability of the Booking portal and the Website will be uninterrupted and that transmissions will be error-free. However, due to the nature of the Internet, this cannot be guaranteed and Aviaxpert reserves the right to withdraw or amend access to the Booking Portal on the Website without notice. Guest(s) access to the Website or the Booking Portal may also be occasionally suspended or restricted to allow for repairs, maintenance, or the introduction of new facilities or services. Aviaxpert will attempt to limit the frequency and duration of any such suspension or restriction. For the avoidance of doubt Aviaxpert will not be liable if for any reason its Website or the Booking Engine is unavailable at any time or period.
7.1 If Guest(s) wish to cancel their booking must
(1). Request for the cancellation of booked service using ‘Cancel/ Manage my Booking’ tab provided on Home Page of Website; or
(2) once the booking is cancelled, refund process will be initiated and necessary credit will be provided to the Guest(s) subject to the deduction of applicable cancellation charges.Total refund on cancellations shall only be if cancellation is before 24hrs from the scheduled service time. No refund shall be given on cancelations within 24hrs from the scheduled service time
Note: For the purpose of calculating cancellation charges, Booking Amount shall mean the total amount (Including taxes) paid by the Guest(s). Transaction fee is non refundableAviaxpert shall endeavor to process refund if applicable, within 15 days from the date of cancellation and receipt of bank/credit card details.

8.1 Aviaxpert reserves the right to amend, add to, change or remove any part of these Terms and Conditions at any time, without notice. Any changes to these Terms and Conditions or any terms posted on the Website apply as soon as they are posted. By continuing to use the Website after any changes are posted, Guest(s) are indicating Guest(s) acceptance of those changes.
8.2 Aviaxpert may add, change, discontinue, remove or suspend any other content posted on the Website, including features and specifications of products described or depicted on the Website, temporarily or permanently, at any time, without notice and without liability.
8.3 Aviaxpert reserves the right to undertake all necessary steps to ensure that the security, safety and integrity of Aviaxpert systems as well as its client’s interests are and remain, well-protected.
8.4 Aviaxpert may take various steps to verify and confirm the authenticity, enforceability and validity of reservations placed by Guest(s).
8.5 Aviaxpert in its sole and exclusive discretion, conclude that any reservation(s) is not or do not reasonably appear to be, authentic, enforceable or valid, then Aviaxpert may cancel the said reservation any time before or during the Service.
8.6 Any communications or materials to the Website by electronic mail or otherwise, including any comments, data, questions, suggestions or the like, all such communications are, as may be received by Aviaxpert will be treated by Aviaxpert as non-confidential.
8.7 Guest(s) hereby give up any and all claim that any use of such material violates any of Guest(s) rights including moral rights, privacy rights, proprietary or other property rights, publicity rights, rights to credit for material or ideas, or any other right, including the right to approve the way Aviaxpert uses such material.
8.9 Guest(s) acknowledges that Internet transmissions are never completely private or secure. Guest(s) further understands that any message or information as may be sent to Aviaxpert website may be read or intercepted by others unless there is a special notice that a particular message (for example, credit card information) is encrypted (send in code). Sending a message or email or any communication written or verbal to Aviaxpert does not cause Aviaxpert to have any special responsibility to Guest(s).
When the Guest visit the Website and make the booking or send e-mail to Aviaxpert\ Airport Kruz for query, Guest(s) are communicating with Aviaxpert electronically. We communicate with Guest(s) by e-mail or by posting notices on the Website. For contractual purposes, Guest(s) consent to receive communications from Aviaxpert electronically and Guest(s) agree that all agreements, notices, disclosures and other communications that we provide to Guest(s) electronically satisfy any legal requirement that such communications be in writing.
Aviaxpert is the owner or the licensee of all intellectual property rights in the Website and the Booking Portal, and in the material published on the Website and in the Booking Portal. The services are protected by copyright laws and treaties around the world. All such rights are reserved.
Guest(s) must not modify the paper or digital copies of any materials Guest(s) have printed off or downloaded in any way from the Booking Portal.
Aviaxpert status (and that of any identified contributors) as the authors of material on Aviaxpert Website must always be acknowledged.
If Guest(s) or any sub-user authorised by Guest(s) print off, copy or download any part of Aviaxpert Website or use the Booking Engine in breach of these terms and conditions, Guest(s) right to use Aviaxpert Website and the Booking Engine shall cease immediately and Guest(s) must, at Aviaxpert option, return or destroy any copies of the materials Guest(s) have made.
Guest(s) do not, by using the Website or the Booking Engine, acquire any ownership or other rights to any content or other materials contained on or accessible through the Website or the Booking Engine.
Some of the provisions contained in these terms and conditions may also be superseded by provisions or notices published elsewhere on Aviaxpert Website.
Bookings made by Guest(s) through Website using the Booking Engine are governed by these terms and conditions and Guest(s) must read these Term and Conditions and click the "I agree to all terms and conditions" button prior to the use of PRM Services. Once the Guest(s) click the button and continue to use the PRM services, Guest(s) will be deemed to have accepted the Booking Conditions on behalf of the Guest(s) and any person for whom Guest(s) have made a booking.
Where Guest(s) input data into the Booking Engine on behalf of someone else, Guest(s) confirm that Guest(s) have obtained their consent to do so, and that they have not objected to the uses of their personal information for the purpose of a booking made through the Booking Engine. Guest(s) also confirm that, in relation to any personal or other details relating to Guest(s) employees or customers or their families in Guest(s) possession Guest(s) shall, at all times, process such data in compliance with any applicable data protection legislation in Guest(s) country.
13.1 These terms and conditions are subject to the terms and conditions of the between Aviaxpert Pvt Ltd and MIAL dated 17Th January 2017
13.2 Failure to comply with the terms and conditions constitutes a material breach and may result in Aviaxpert taking all or any of the following actions:
Guest(s) agree to indemnify Aviaxpert for any costs, liabilities and losses whatsoever incurred by Aviaxpert arising out of any action or inaction by Guest(s) that result in Aviaxpert being in breach of any provisions of applicable data protection legislation in Guest(s) country.
In case of any difference and/or dispute between the Aviaxpert and Guest, the same shall be referred to arbitration of a sole arbitrator to be appointed by the Director of Aviaxpert. The award of the sole arbitrator shall be final and binding on the parties. It is understood and expressly accepted that only Courts/ Tribunals/Quasi-Judicial Authorities of New Delhi shall have the jurisdiction to entertain any dispute arising out of this application between the Applicant and the Company. The venue of Arbitration shall be at New Delhi.
Disputes, if any, shall be subject to Indian laws and shall be exclusively subject to the jurisdiction of the courts at New Delhi.
